Terms and Conditions of Use
Effective Date: May 2026
These Terms and Conditions (“Terms”) govern all access to and use of the Bandauko E-Commerce platform, including the website at bandauko.co.zw, any associated mobile applications, and all related services (collectively, the “Platform”).
By registering, listing products or services, placing an order, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. DEFINITIONS
“Platform”
The Bandauko E-Commerce website (bandauko.co.zw), mobile applications, and all associated digital services operated by Bandauko E-Commerce (PVT) Ltd.
“Bandauko”
Bandauko E-Commerce (PVT) Ltd, the company registered in Zimbabwe that owns and operates the Platform.
“User”
Any individual or entity that accesses or uses the Platform, including Vendors (both formal and informal traders), Service Providers, and Customers.
“Vendor”
A registered seller (including formal businesses and informal micro-traders) who lists physical products for sale on the Platform.
“Service Provider”
A registered professional or business that lists services, including but not limited to plumbing, electrical work, construction, cleaning, IT, and other trade services, on the Platform under a subscription arrangement.
“Customer”
A User who purchases products or books services through the Platform.
“Transaction”
Any completed sale of a product or confirmed booking of a service facilitated through the Platform.
“Commission”
The platform service fee of two percent (2%) deducted from the gross value of each completed product transaction.
“Subscription Fee”
The recurring fee payable by Service Providers to maintain an active service listing on the Platform.
“EcoCash”
The mobile money payment service operated by Econet Wireless Zimbabwe, integrated as a primary payment rail on the Platform.
“Content”
All text, images, descriptions, pricing, reviews, and other material uploaded or submitted by Users to the Platform.
2. ELIGIBILITY AND REGISTRATION
2.1 Eligibility
The Platform is available to individuals aged 18 years and above, and to legally constituted business entities or informal traders operating within Zimbabwe or in any jurisdiction from which use of the Platform is lawful. By registering, you represent and warrant that you meet these eligibility requirements.
2.2 Registration Requirements
All Vendors and Service Providers must register on the Platform using a valid Zimbabwean national identity document or, where applicable, a valid business registration document. The Platform is fully inclusive of, and open to, both registered corporate entities and informal micro-traders.
A valid mobile phone number capable of receiving mobile money transactions, or a verified bank account, is required for transaction fulfillment and disbursements.
2.3 Account Accuracy
You are responsible for ensuring that all information provided during registration, and at all subsequent times, is accurate, current, and complete. Bandauko reserves the right to suspend or terminate any account where inaccurate or misleading information is discovered.
2.4 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify Bandauko immediately at info@bandauko.co.zw if you suspect any unauthorised access to your account.
3. VENDOR TERMS – PRODUCT LISTINGS
3.1 Listing Products
Vendors may list products on the Platform following successful registration. Product listings must include accurate descriptions, current pricing, and photographic representations of the actual goods offered. Listings must not misrepresent the nature, quality, or availability of products.
3.2 Inventory Ownership
Vendors retain full ownership and physical custody of all listed inventory at all times. Bandauko does not hold, store, or take ownership of any Vendor stock at any stage of the transaction process.
Vendors are responsible for ensuring that listed products are available, properly packaged, and ready for collection upon order confirmation.
3.3 Prohibited Products
Vendors may not list products that are illegal under Zimbabwean law, counterfeit, stolen, subject to import or export restrictions, or otherwise harmful.
Bandauko reserves the right to remove any listing and suspend any Vendor account where prohibited goods are detected, without prior notice and without liability.
3.4 Pricing and Currency
All product prices must be stated in United States Dollars (USD) or Zimbabwe Gold (ZiG), as applicable.
Vendors are responsible for setting and maintaining accurate prices and for updating listings promptly when prices change. Bandauko is not liable for any loss arising from pricing errors made by Vendors.
3.5 Order Fulfilment Obligation
Upon receipt of an order notification, Vendors are obligated to prepare the ordered item for collection within the agreed timeframe.
Repeated failure to fulfil confirmed orders will result in account suspension or termination at Bandauko’s sole discretion.
4. PLATFORM COMMISSION – PRODUCT SALES
BANDAUKO CHARGES A PLATFORM COMMISSION OF TWO PERCENT (2%) ON EVERY COMPLETED PRODUCT SALE. This fee is automatically deducted prior to Vendor payout.
4.1 Commission Rate
Bandauko charges a platform service commission of two percent (2%) of the gross transaction value on every completed product sale facilitated through the Platform.
This commission is Bandauko’s fee for providing the marketplace infrastructure, payment processing, and order management services.
4.2 Calculation
The commission is calculated on the gross sale price of the product, inclusive of any delivery fee charged to the Customer, and exclusive of any applicable taxes.
4.3 Deduction and Payout
The 2% commission is automatically deducted from the transaction amount held in escrow before funds are released to the Vendor.
Vendor payouts are processed upon confirmed delivery of the order and can be disbursed via EcoCash (or other integrated mobile money accounts), direct bank transfer, or cash collection, depending on the Vendor’s selected payout preference.
Bandauko targets same-day payout for confirmed deliveries, subject to the operational capacity and hours of the chosen financial network or cash settlement facility.
4.4 Commission Review
Bandauko reserves the right to revise the commission rate with a minimum of thirty (30) days’ written notice to registered Vendors.
Any revised rate applies to Transactions completed after the effective date of the change and does not affect Transactions in progress at the time of notification.
4.5 No Hidden Fees
The 2% commission is the only platform fee charged to Vendors for completed product sales.
There are:
- No listing fees;
- No monthly subscription fees for product Vendors; and
- No additional transaction charges beyond the commission stated herein.
Delivery fees, where applicable, are separate arrangements established between Bandauko and its authorised delivery partners.
5. SERVICE PROVIDER TERMS – SUBSCRIPTION LISTINGS
SERVICE PROVIDERS MUST HOLD AN ACTIVE SUBSCRIPTION TO LIST ON THE PLATFORM. Subscription tiers and pricing are published on bandauko.co.zw.
5.1 Service Provider Eligibility
Service Providers include, but are not limited to:
- Plumbers;
- Electricians;
- Construction contractors;
- Painters;
- Carpenters;
- Cleaners;
- Landscapers;
- Security companies;
- IT technicians;
- Tailors;
- Appliance repair technicians;
- Transport operators;
- Photographers;
- Caterers;
- Tutors; and
- Other trade or professional service businesses.
Any individual or entity, including informal sole traders and artisans, offering a lawful service may apply to list on the Platform.
5.2 Subscription Requirement
Access to the Service Provider listing interface is conditional upon the purchase and maintenance of an active subscription.
Subscriptions are available in tiers, with pricing, benefits, and billing cycles published on the Platform at bandauko.co.zw.
A Service Provider whose subscription has lapsed will have their listing deactivated until the subscription is renewed.
5.3 Subscription Tiers
Bandauko offers multiple subscription tiers designed to accommodate Service Providers of all sizes, from individual sole traders to established companies.
Tier benefits may include:
- Enhanced listing visibility;
- Priority placement in search results;
- The ability to list multiple service categories;
- Access to analytics; and
- Promotional placement on the Platform.

5.4 Service Listing Standards
Service listings must accurately describe:
- The services offered;
- The geographic areas served;
- Indicative pricing or rates;
- Qualifications or certifications held, where relevant; and
- Availability.
Bandauko reserves the right to require documentary verification of qualifications for regulated trades (e.g. electrical and plumbing work) before approving or maintaining a service listing.
5.5 Customer Bookings
Customers may contact and book Service Providers directly through the Platform.
Bandauko facilitates the introduction and booking but is not a party to the service agreement between the Service Provider and the Customer.
Service Providers are solely responsible for the delivery of services booked through the Platform.
5.6 Ratings and Reviews
Customers may submit ratings and written reviews following completion of a service.
Service Providers agree to the publication of verified customer reviews on their Platform listing.
Bandauko will not remove genuine negative reviews but will investigate and remove reviews that are fraudulent, abusive, or in violation of these Terms.
5.7 No Commission on Service Bookings
Bandauko does not charge a transaction commission on service bookings.
The Subscription Fee is the sole platform charge applicable to Service Providers.
Service Providers and Customers determine payment terms for services directly between themselves.
6. PAYMENTS AND FINANCIAL TERMS
6.1 Payment Methods
The Platform accepts:
- EcoCash;
- OneMoney;
- Other mobile money services integrated at the time of transaction;
- Bank transfers; and
- Other verified payment modalities where available.
Bandauko reserves the right to add or remove payment methods at any time with reasonable notice to Users.
6.2 Escrow Arrangement
Customer payments for product purchases are held in a platform escrow arrangement pending confirmed delivery.
Funds are not released to the Vendor until delivery has been confirmed either by the Customer or by the Platform’s delivery tracking system.
This arrangement protects both Customers and Vendors against non-delivery or delivery disputes.
6.3 Taxes
Vendors and Service Providers are solely responsible for determining and fulfilling their own tax obligations arising from sales or services conducted through the Platform, including any obligations to the Zimbabwe Revenue Authority (ZIMRA).
Bandauko does not withhold tax on behalf of Vendors or Service Providers except where legally required to do so.
6.4 Refunds
Customers are entitled to request a refund where an ordered product:
- Is not delivered;
- Is significantly different from its description; or
- Arrives in a damaged condition.
Refund requests must be submitted through the Platform’s dispute resolution interface within 48 hours of the scheduled delivery time.
Bandauko’s decision on refund requests, made in good faith, is final.
7. DELIVERY AND LOGISTICS
7.1 Delivery Partners
Last-mile delivery of product orders is facilitated through Bandauko’s approved networks of delivery and fulfillment partners.
This network includes Mushe Market’s electric bike courier infrastructure alongside other approved third-party couriers, independent contractors, and logistics networks onboarded by the Platform from time to time.
Delivery availability, coverage areas, and estimated delivery times are subject to the operational capacity of the respective logistics partner and are published transparently on the Platform.
7.2 Vendor Collection Obligation
Vendors must ensure that ordered products are packaged, labelled, and ready for collection at the confirmed collection time.
Failure to have an order ready for collection may result in a failed delivery, which will be recorded against the Vendor’s performance record.
7.3 Delivery Fees
Delivery fees are charged to Customers at the time of purchase and are displayed transparently before order confirmation.
Delivery fees are not included in the Vendor’s gross transaction value for the purposes of commission calculation.
7.4 Risk and Liability
Risk in the product passes:
- From the Vendor to the designated delivery partner upon collection; and
- From the delivery partner to the Customer upon confirmed delivery.
Bandauko’s liability for loss or damage during transit is limited strictly to the platform commission value of the affected transaction.
8. ADVERTISING AND PROMOTED LISTINGS
8.1 Advertising Availability
The Platform provides advertising and promoted listing opportunities for Vendors, Service Providers, and third-party organisations seeking to reach Bandauko’s user base.
Advertising products include:
- Promoted product listings;
- Sponsored service profiles;
- Banner placements; and
- Category-level promotions.
8.2 Advertising Standards
All advertising content must be truthful, compliant with Zimbabwean advertising standards, and must not promote prohibited goods or services.
Bandauko reserves the right to reject, modify, or remove advertising content that does not meet these standards, without refund of advertising fees paid.
8.3 Advertising Pricing
Advertising pricing is available on application and varies by placement, duration, and audience reach.

9. USER CONDUCT AND PROHIBITED ACTIVITIES
9.1 General Conduct
All Users must conduct themselves with honesty, respect, and professionalism in all interactions on the Platform.
Bandauko reserves the right to suspend or terminate any account where conduct is found to be fraudulent, abusive, threatening, or otherwise contrary to these Terms.
9.2 Prohibited Activities
Users must not engage in any of the following activities:
- Listing counterfeit, stolen, or illegal goods or services;
- Manipulating product or service reviews through false submissions or coercion;
- Attempting to conduct transactions outside the Platform to circumvent commission or subscription obligations;
- Impersonating any other person, business, or organisation;
- Using the Platform to send unsolicited commercial communications (spam);
- Attempting to access, disrupt, or compromise the Platform’s technical infrastructure; or
- Violating any applicable Zimbabwean law or regulation in connection with Platform use.
10. INTELLECTUAL PROPERTY
10.1 Bandauko IP
All intellectual property in the Platform, including but not limited to the Bandauko name, logo, trade marks, software, design, and proprietary processes, is owned by or licensed to Bandauko E-Commerce (PVT) Ltd.
No User acquires any right, title, or interest in Bandauko’s intellectual property through the use of the Platform.
10.2 User Content Licence
By uploading or submitting Content to the Platform, you grant Bandauko a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that Content for the purposes of operating and promoting the Platform.
You retain ownership of your Content and may request its removal subject to these Terms.
10.3 Content Representations
You represent and warrant that any Content you submit:
- Does not infringe the intellectual property rights of any third party;
- Does not contain defamatory or unlawful material; and
- Is accurate and not misleading.
11. PRIVACY AND DATA PROTECTION
11.1 Data Collection
Bandauko collects personal data from Users for the purposes of:
- Account management;
- Transaction processing;
- Platform improvement; and
- Marketing communications, where consent is given.
Data collection and processing practices are governed by Bandauko’s Privacy Policy, available at bandauko.co.zw.
11.2 Data Security
Bandauko implements reasonable technical and organisational measures to protect User data against unauthorised access, loss, or disclosure.
However, no digital platform can guarantee absolute security, and Users provide data at their own risk.
11.3 Transaction Data
Bandauko retains anonymised and aggregated transaction data generated on the Platform.
This data may be used for:
- Internal analytics;
- Product development; and
- Commercial data services in aggregated form.
No individually identifiable transaction data will be shared with third parties without User consent, except as required by law.
12. DISPUTE RESOLUTION
12.1 Platform Disputes
Any dispute between a Customer and a Vendor or Service Provider arising from a Platform transaction must first be submitted through the Platform’s in-app dispute resolution process.
Bandauko will investigate disputes in good faith and communicate a decision within five (5) business days of a complete dispute submission.
12.2 Escalation
Where a dispute cannot be resolved through the Platform’s dispute resolution process, either party may refer the matter to mediation.
Bandauko recommends the use of a mutually agreed independent mediator based in Zimbabwe.
The costs of mediation are shared equally between the parties.
12.3 Governing Law
These Terms are governed by and construed in accordance with the laws of Zimbabwe.
Any legal proceedings arising from these Terms shall be brought in the courts of Zimbabwe, and all parties irrevocably submit to the jurisdiction of those courts.
13. LIMITATION OF LIABILITY AND DISCLAIMER
13.1 Platform as Marketplace
Bandauko operates as a marketplace facilitator and is not the seller or supplier of any product or service listed by Vendors or Service Providers on the Platform.
Bandauko does not inspect, endorse, or warrant the quality, safety, legality, or accuracy of any listing.
13.2 Limitation of Liability
To the maximum extent permitted by applicable law, Bandauko’s aggregate liability to any User arising from or in connection with these Terms or the use of the Platform shall not exceed the total commission or subscription fees paid by that User to Bandauko in the three (3) calendar months immediately preceding the event giving rise to the claim.
13.3 Force Majeure
Bandauko shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond Bandauko’s reasonable control, including but not limited to:
- Acts of God;
- Power failures;
- Telecommunications outages;
- Government actions; or
- Network operator disruptions.
14. ACCOUNT SUSPENSION AND TERMINATION
14.1 Termination by User
Any User may close their account at any time by submitting a written request to info@bandauko.co.zw.
Account closure does not release any outstanding financial obligations, including unpaid subscription fees or unresolved transaction disputes.
14.2 Suspension or Termination by Bandauko
Bandauko may suspend or terminate any User account, with or without prior notice, where the User is found to have:
- Breached these Terms;
- Engaged in fraudulent or abusive activity;
- Listed prohibited goods or services; or
- Otherwise acted in a manner detrimental to the integrity of the Platform or the safety of other Users.
14.3 Effect of Termination
Upon account termination:
- All active listings will be deactivated;
- All pending transactions will be resolved in accordance with these Terms; and
- Any outstanding subscription fees already paid will not be refunded except at Bandauko’s sole discretion.
15. AMENDMENTS TO THESE TERMS
15.1 Right to Amend
Bandauko reserves the right to amend these Terms at any time.
Material changes, including any change to the commission rate or subscription fees, will be communicated to registered Users with a minimum of thirty (30) days’ notice via the Platform or by email to the registered account address.
15.2 Continued Use
Continued use of the Platform following the effective date of any amendment constitutes acceptance of the revised Terms.
If you do not accept the amended Terms, you must cease use of the Platform and close your account before the effective date of the change.
